Gaviota Tours

1. Participant Responsibility

I am aware that I must not feed any animals found in the wild during the tour.

2. Cancellations and Refunds

In the event that the tour is canceled due to bad weather or force majeure, all money paid after the booking date will be refunded. No refunds or credits will be granted if customers miss the boat trip. However, reservations can be canceled or rescheduled, subject to availability, with a maximum of 24 hours' notice before departure.

3. Waiver and Release of Liability

As a participant in the activity, I am aware of the following:

• Associated Risks

I acknowledge that participating in Gaviota Tour activities may involve risks of injury, including but not limited to illness, paralysis, and death. I assume all risks related to my participation.

• Release of Liability

I waive all rights, claims, or causes of action arising from my participation in this activity, releasing Gaviota Tour and its affiliates from any liability for physical or psychological injuries.

• Responsibility for Personal Belongings

I am aware that Gaviota Tour is not responsible for lost, stolen, or damaged items during the tour.

• Indemnification

I agree to indemnify and hold Gaviota Tour harmless from any claim or demand that may arise from my participation.

• Medical Expenses

I am financially responsible for any medical care or treatment I may require during the tour.

4. Health Conditions

I agree to disclose any medical condition that may affect my participation in the tour to the staff.

5. Emergency Consent

In case of an emergency, I authorize Gaviota Tour to seek medical care on my behalf.

6. Code of Conduct

As a participant, I am responsible for maintaining respectful behavior towards the captain, the guide, and other tour members. I will also comply with Gaviota Tour’s health and safety regulations and follow staff instructions at all times.

7. Liability for Damages

I agree to assume financial responsibility for any damage I may cause, whether to Gaviota Tour’s property or to third parties, during the tour.

8. Insurance

I understand that I must have my own health insurance. Gaviota Tour provides an insurance policy that covers only the duration of the tour. Additionally, Gaviota Tour is not responsible for any damages or losses occurring before or after the contracted activity.

9. Photographs and Recordings

I agree that Gaviota Tour may take photographs or recordings during the tour. Furthermore, by taking the tour, I am aware that I am granting Gaviota Tour the rights to my image for promotional purposes.

10. Competence and Coercion

This Agreement is entered under fair conditions, without coercion. Both parties agree that this Agreement is clear and unambiguous

11. Severability

If any provision of this Agreement is deemed invalid, the remainder of the Agreement shall remain in effect.

12. Agreement Acceptance

I certify that I have read this Agreement, understand its contents, and accept it voluntarily. If the participant is a minor (under 18 years old), they must be accompanied by a responsible adult, and this declaration must be accepted by the parent or guardian. By taking the tour, I agree to the terms and conditions of the contract.
