1. 1. Participant Responsibility

I am aware that I must not feed any animals found in the wild during the tour.

2. 2. Cancellations and Refunds

In the event that the tour is canceled due to bad weather or force majeure, all money paid after the booking date will be refunded. No refunds or credits will be granted if customers miss the boat trip. However, reservations can be canceled or rescheduled, subject to availability, with a maximum of 24 hours' notice before departure.

3. 3. Waiver and Release of Liability

As a participant in the activity, I am aware of the following:

• • Associated Risks

Reconozco que participar en las actividades de Gaviota Company Tour CR implica riesgos de lesiones, incluyendo, pero no limitándose a, enfermedades, parálisis, y muerte. Asumo todos los riesgos relacionados con mi participación.

• • Release of Liability

Renuncio a todos los derechos, reclamos o causas de acción que surjan de mi participación en esta actividad, liberando a Gaviota Company Tours CR y sus afiliados de cualquier responsabilidad por lesiones físicas o psicológicas.

• • Responsibility for Personal Belongings

Soy consciente de que Gaviota Company Tours CR no se hace responsable por objetos perdidos, robados o dañados durante el tour.

• • Indemnification

Acepto indemnizar y eximir de responsabilidad a Gaviota Company Tour CR contra cualquier reclamo o demanda que surja de mi participación.

• • Medical Expenses

I am financially responsible for any medical care or treatment I may require during the tour.

4. 4. Health Conditions

I agree to disclose any medical condition that may affect my participation in the tour to the staff.

5. 5. Emergency Consent

En caso de emergencia, autorizo a Gaviota Company Tour CR a buscar atención médica en mi nombre.

6. 6. Code of Conduct

Como participante me responsabilizo en mantener un comportamiento respetuoso hacía el capitán, el guía y los otros integrantes del tour. Además de cumplir con las normas de salud y seguridad establecidas por Gaviota Company Tour CR y seguir las indicaciones del personal en todo momento.

7. 7. Liability for Damages

Me comprometo a asumir la responsabilidad financiera por cualquier daño que cause, ya sea a la propiedad de Gaviota Company Tour CR o a terceros, durante el transcurso del tour.

8. 8. Insurance

Entiendo que debo contar con mi propio seguro de salud. Gaviota Company Tour CR proporciona una póliza de seguro que cubre durante el tour. Además, Gaviota Company Tour CR no se hace responsable de los daños y perjuicios que ocurran antes o después de la actividad contratada.

9. 9. Photographs and Recordings

Acepto que Gaviota Company Tour CR pueda tomar fotografías o grabaciones durante el recorrido. Además, al aceptar el recorrido, soy consciente de que le estoy otorgando los derechos de imagen a Gaviota Company Tour CR para ser utilizados con fines promocionales.

10. 10. Competence and Coercion

This Agreement is entered under fair conditions, without coercion. Both parties agree that this Agreement is clear and unambiguous

11. 11. Severability

If any provision of this Agreement is deemed invalid, the remainder of the Agreement shall remain in effect.

12. 12. Agreement Acceptance

I certify that I have read this Agreement, understand its contents, and accept it voluntarily. If the participant is a minor (under 18 years old), they must be accompanied by a responsible adult, and this declaration must be accepted by the parent or guardian. By taking the tour, I agree to the terms and conditions of the contract.
